A father, Perry Kansagra, obtained a custody order over his minor son Aditya in October 2020 from India's Supreme Court by fraudulently representing that he had obtained a valid mirror order from Kenya's High Court. When the order was challenged, it emerged that Kenya's High Court had dismissed Perry's application in May 2021 for lack of jurisdiction and because custody matters are excluded from Kenya's judgment enforcement law—a fact Perry suppressed. The Court found Perry had given solemn undertakings to comply with orders but deliberately defied visitation rights, blocked communication, and later challenged Indian jurisdiction in Kenya courts. The Supreme Court recalled the custody orders, declared them void ab initio, dismissed the underlying guardianship proceedings, and initiated contempt action and criminal investigation against Perry to restore the child's welfare.
