A mother and father-in-law sought to evict their daughter-in-law and her child from a residential property under the Maintenance and Welfare of Parents and Senior Citizens Act 2007, claiming ownership. The daughter-in-law contested the eviction, asserting the property was her shared household under the Protection of Women from Domestic Violence Act 2005 (PWDV Act). The Supreme Court held that while Tribunals under the Senior Citizens Act may order eviction to protect senior citizens, such power cannot be used to defeat a woman's competing right to reside in a shared household under the PWDV Act. The Court harmonised the two statutes, setting aside the eviction order and directing that the daughter-in-law be allowed to pursue her remedies under the PWDV Act, with interim protection from dispossession for one year.
