Som Dutt and others were convicted by a trial court for theft of a tractor under Section 379 IPC (read with Section 34) and sentenced to three months imprisonment and a fine. The conviction was upheld by the Sessions Court and High Court. The Supreme Court, while maintaining the conviction and sentence, allowed the appeal by releasing the appellants on probation of good conduct for three years. Each appellant was required to furnish a personal bond of Rs. 25,000 with surety, given their lack of criminal antecedents and the relatively minor sentence imposed.
