The appellant (sister) and respondent (brother) disputed their inheritance shares in properties left by their father. The trial court awarded the appellant ½ share in a particular agricultural land (item 3) acquired by their father under occupancy rights under the Inam Act, along with a ¼ share in ancestral properties. The High Court reduced her share in item 3 to ¼ without adequately considering evidence. The Supreme Court held the High Court erred procedurally and confirmed the trial court's award of ½ share to the appellant in item 3, as the property was the father's self-acquired property heritable by both children equally.
