The case involved whether state regulators can deduct a central government Generation Based Incentive (GBI) scheme from tariff payable to renewable energy generators. While holding that regulators have exclusive tariff-setting power and can "consider" government incentives, the Court ruled that GBI—designed to promote renewable energy investment—cannot be mechanically deducted as a tariff adjustment. The GBI must remain separate and paid over and above tariff. The Court emphasized that regulatory bodies must work collaboratively with government to advance renewable energy policy goals.
