In Brief
Southern Sea Foods Ltd challenged an income tax decision that was upheld by the High Court. The Supreme Court examined the legal precedent established in Commissioner of Income Tax, Thiruvananthapuram v. Baby Marine Exports, Kollam and its subsequent application in Commissioner of Income Tax, Karnal v. Dalbir Singh. Finding the High Court's decision inconsistent with established precedent, the Supreme Court allowed the appeal, set aside the High Court's order, and directed that all consequential reliefs be granted to the appellant.
