In this case, the Supreme Court examined a High Court judgment in a Second Appeal. The High Court had interfered with findings of the Trial Court and First Appellate Court without formulating a substantial question of law, as mandated by Section 100 of the Code of Civil Procedure. The Supreme Court held that formulating a substantial question of law is a mandatory requirement for deciding Second Appeals, and cannot be bypassed even if the lower courts' findings appear perverse.
