In Brief
The appellants challenged orders by the High Court and First Appellate Court that had allowed the respondent to seek production of a Mutation Register during a regular appeal in a suit already dismissed at the plaint rejection stage. The Supreme Court held that Order 11 Rule 14 of the CPC (which permits production of documents during a suit) does not apply after a plaint has been rejected under Order VII Rule 11. An appellate court reviewing such a dismissal may only examine the validity of the rejection order, not the merits or require production of new documents. The Court set aside the order for document production but upheld the allowance of additional grounds in the appeal.",
