State Bank of India appealed against an order of the National Consumer Disputes Redressal Commission (NCDRC) that held the bank liable on an insurance claim. The insurance claim arose from a fire incident but was submitted more than six and a half years later. The NCDRC found the insurer not liable due to delay but held the bank liable instead without justification. The Supreme Court allowed the appeal, holding that since the borrower had not challenged the original State Commission order, the NCDRC could not foist liability on the bank. The insurance liability issue alone was in controversy.
