The Supreme Court dismissed the CBI's appeal against the Madras High Court's order discharging the respondent Uttamchand Bohra from criminal charges. The CBI had charged him with conspiracy and abetment for allegedly aiding a public servant to amass disproportionate assets. The sole evidence was possession of a sale deed found in Uttamchand's residence and the fact that his employee witnessed the document. The Court held that mere possession of a title deed and a witness signature are wholly insufficient to establish a prima facie case of conspiracy or abetment. Suspicion alone cannot justify framing charges; there must be grave suspicion supported by cogent evidence of agreement and illegal act.
