Supreme Court of India 2019-05-07 disposed

State by the Superintendent of Police, National Investigation Agency, Kochi vs Shakul Hameed

Bench: 2 — Rastogi

In Brief

A radicalized youth from Chennai involved in a conspiracy to join ISIS in Syria was arrested and remanded for 90 days. When this period expired, the Special Court extended detention for another 90 days based on the Public Prosecutor's report citing ongoing investigation, forensic analysis of seized devices, and international inquiries under mutual legal assistance treaties. The High Court set aside this order, holding that reasons did not justify extended detention, and granted default bail. The Supreme Court found the reasons valid but declined to interfere with the bail granted in changed circumstances (charge-sheet filed, co-accused already bailed, no breach by the respondent), leaving open the option for prosecution to seek cancellation if needed.",
