An Ayurvedic Medical Officer appointed in Bihar before its 2000 reorganization was initially allocated to Jharkhand, then reassigned to Bihar in 2010 with both States' consent. However, Jharkhand failed to relieve him, and he continued working there until retirement in 2017. Filing a writ petition only days before superannuation, he sought to join Bihar. The Supreme Court allowed Bihar's appeal, holding that the employee had failed to pursue timely legal remedies to enforce the 2010 reallocation order and could not now claim the benefit after seven years of continued service and attaining superannuation in Jharkhand.
