In a money recovery suit, defendants sought to amend their written statement to elaborate on facts already pleaded. Both the Trial Court and High Court rejected this amendment application. The Supreme Court held that amendments expanding or amplifying originally pleaded facts—rather than introducing wholly new defenses—should be allowed when trial remains incomplete and no prejudice results to the plaintiff. The Court allowed the amendment, also giving the plaintiff opportunity to amend the plaint and adduce further evidence before the defendant's evidence began.
