State of Gujarat vs Navinbhai Chandrakant Joshi etc

Bench: 2 — R. Banumathi

In Brief

A businessman (PW-1) applied for permission to convert agricultural land to non-agricultural use for a manufacturing unit. A junior clerk (accused No. 1) demanded Rs.500 as a bribe to expedite approval. The accused accepted the marked money through an intermediary colleague (accused No. 2) during a police trap. Both were convicted and the High Court reversed the conviction. The Supreme Court held that the demand, acceptance, and the corroborating evidence (marked currency notes and anthracene powder traces on both accused) clearly proved the offence under the Prevention of Corruption Act. The conviction was restored with reduced sentence.
