The Supreme Court addressed whether a government employee was eligible for selection to a higher post in the Haryana Civil Service when disciplinary action had been contemplated against him. The Court held that the eligibility assessment date for disciplinary-proceeding conditions is the date of consideration (when the committee made recommendations), not an earlier date. Even though a general instruction mentioned 01.11.2018 as a reference date, clarifications made it plain this applied only to age-related checks. Since disciplinary action was genuinely contemplated against the respondent by the relevant date, he was properly found ineligible for selection. The Supreme Court set aside the High Court's order favouring the employee and restored the Single Judge's decision upholding the State's rejection.
