State of Haryana & Ors vs Bira @ Bhira & Ors

Bench: 1 — Prafulla C. Pant

In Brief

The State of Haryana challenged the High Court's acquittal of Bira @ Bhira in a murder case where three accused were charged with attacking and killing Vakil Singh, a man recently acquitted in another murder case. While the Supreme Court upheld the conviction of Sant Lal (the deceased victim's son in the related case) and Fatta Ram (who was caught fleeing the scene), it affirmed Bira @ Bhira's acquittal. The Court found insufficient evidence proving Bira's presence and participation beyond reasonable doubt, noting he was a son-in-law from a separate village and could have been implicated due to enmity. The appeal and special leave petition were dismissed."
