The State of Haryana appealed against High Court orders quashing land acquisition proceedings and directing release of acquired land. The Court held that two of three writ petitions were correctly dismissed: land needed for road widening and land already utilized for a sewage system (with Rs. 17 crores invested) cannot be released. However, regarding land initially acquired in 1987 for Sector 11 development where 38.7 acres of the 46.49-acre acquisition had been released by the State, while small plots of the petitioners remained under acquisition without demonstrated public need, the Court dismissed the appeal, finding the High Court's release order justified on parity grounds under Article 14.
