State of Jammu and Kashmir & Ors vs District Bar Association, Bandipora

Bench: 3 — D.Y. Chandrachud

In Brief

The Supreme Court examined whether the High Court could order regularization of 209 daily-wage workers in Jammu & Kashmir's judiciary without following constitutional recruitment principles. The High Court had directed en masse regularization in a PIL originally seeking district court infrastructure. The Court held that while the State is constitutionally obliged to create adequate sanctioned posts for the judiciary—a duty it had negligently neglected—regularization cannot be court-ordered. Such schemes must follow the principles in Umadevi and Renu, distinguishing irregular from illegal appointments. The Court set aside the High Court's order and remitted for fresh consideration on proper constitutional grounds."
