The Supreme Court faced a conflict in case law concerning whether it can entertain an application to make an arbitral award a rule of the Court when it retains control over the arbitration. One line of authority held that if an arbitrator is directed to file the award in the Supreme Court, objections and applications must be filed there. Another line held that parties have a valuable right to appeal and the Supreme Court is not a "Court" under the Arbitration Act merely by retaining seisin. Finding this conflict irreconcilable, the Court referred the matter to a larger bench to decide the jurisdictional question.
