The State of Jharkhand appealed an order granting full pay and allowances to a suspended employee (Amresh Narayan Sinha) upon revocation of his suspension, even though departmental proceedings remained pending against him. The Supreme Court held that when an authority revokes a suspension, it must make a specific order regarding pay and allowances at that time. Where the suspension is found wholly unjustified, the employee is entitled to full pay and allowances as if the suspension never occurred. The Court allowed the appeal and directed that a decision on pay and allowances be taken after the criminal trial concludes.
