The State of Jharkhand appealed against the High Court's order granting bail to an accused charged under Section 18 of the Narcotic Drugs and Psychotropic Substances Act. The accused was arrested for possession of narcotic substances. After bail was granted in November 2022, the accused was arrested again in July 2023 for a similar NDPS offence. The Supreme Court set aside the bail order, finding that the subsequent arrest in a similar offence demonstrated the accused's unsuitability for bail and warranted custody. The trial court was directed to complete the trial within four months.
