The State of Karnataka challenged the partial quashing of a government memo on teacher transfers for higher primary schools. The issue was whether the KCS (Regulation of Transfers of Teachers) Act, 2007 applied to these hybrid schools created under the Sarva Shiksha Abhiyan scheme. The Supreme Court held that the Act did not strictly govern these schools, and the State could validly issue an independent memorandum providing for mutual transfer of teachers. The Court found no violation of the Act and allowed the appeal, recognizing that reference to a statute does not adopt all its provisions when a separate scheme exists.
