State of Karnataka vs Kaisarbaig & Ors

Bench: 2 — Kurian

In Brief

The State of Karnataka challenged the High Court's leniency in modifying convictions for rioting and causing hurt. The accused were originally sentenced to three years' imprisonment but the High Court reduced this to fines of Rs. 3,000–10,000 each. The Supreme Court agreed the original sentence was too heavy but found the High Court's modification too lenient. Balancing the accused's prior jail time, the 2007 incident date, and the parties' settlement, the Court imposed no additional incarceration but increased the total fine to Rs. 50,000 payable to the victim, payable within three months with a default imprisonment clause of three months.
