State of Karnataka vs Linganagouda etc

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The State of Karnataka appealed against the High Court's order quashing proceedings into allegations of illegal mining involving both private persons and public servants. The High Court had held that cognizance under the Mines and Minerals Act could only be taken on complaint by an authorized person, preventing investigation. The Supreme Court allowed the appeal, holding that investigation can proceed before cognizance is taken. The Court found no bar to Lokayukta Police investigating, especially where Prevention of Corruption Act offences are alleged. The order was set aside and investigation was permitted to continue.
