The State of Karnataka appealed against a High Court judgment that had acquitted two accused (Nos. 4 and 5) and reduced the conviction of others from murder to culpable homicide with a five-year sentence. The Supreme Court dismissed the appeal, holding that the High Court's acquittal of accused Nos. 4 and 5 was justified because the eyewitness complaint contained no specific overt act attributed to them, and therefore they could not be held guilty. The Court also found the modification of conviction and sentence reduction reasonable, given that only accused No. 1 had prior enmity with the victim, and the nature of weapons and injuries supported the lesser conviction."
