The State of Kerala challenged a High Court judgment that exempted respondent Mohammed Basheer's land from vesting under the Kerala Private Forests (Vesting and Assignment) Act, 1971. The land measuring about 2 acres had been planted with coffee and the respondent possessed a certificate of purchase issued by the Land Tribunal under the Kerala Land Reforms Act, 1963, certifying his status as the cultivating tenant-owner. The Supreme Court held that the certificate of purchase is conclusive proof of both title and possession under Section 72K(2) of the Land Reforms Act. Since no appeal was filed challenging the certificate despite the State's opportunity to do so under Section 102, the certificate became final and binding. The Court concluded the land was exempted from vesting as it was held under personal cultivation by the owner within the ceiling limit, and dismissed the State's appeal."
