In Brief
A village officer was convicted of demanding and accepting gratification from a property dispute claimant in exchange for a favourable official report. The Trial Court convicted him under the Prevention of Corruption Act, 1988. However, the High Court reversed the conviction, finding that it was not satisfactorily proved how the marked currency notes reached the accused's pocket or whether the chemical test was properly conducted. The Supreme Court dismissed the State's appeal, holding that the High Court's reasoning was cogent and reasonable, and that the Court should not re-appreciate evidence when an acquittal is supported by sound appellate reasoning.
