In Brief
The State of Madhya Pradesh challenged a High Court judgment that had quashed an order by the Competent Authority under the Madhya Pradesh Ceiling on Agricultural Holdings Act, 1960. The original suit, filed by Dungaji, sought a declaration that his marriage had been dissolved by customary divorce and challenged the Authority's order as illegal. The Supreme Court held that the High Court erred in interfering with the factual findings of the Trial Court and First Appellate Court, which were based on proper appreciation of evidence. Accordingly, the Supreme Court restored the Trial Court's judgment dismissing Dungaji's suit and set aside the High Court's judgment.
