This case addresses the distinction between mineral mining violations under the Mines & Minerals (Development & Regulation) Act, 1957 and theft offences under the Indian Penal Code. Illegal miners had been allowed to compound MMDR violations by paying penalties, but a magistrate then directed police to file FIRs for theft charges. The Court held that: (1) offences under the MMDR Act and IPC theft provisions are distinct and separate; (2) the bar requiring authorized officer complaints under Section 22 applies only when taking formal cognizance, not at FIR registration; (3) compounding MMDR violations does not bar theft prosecutions; (4) magistrates may suo motu direct FIR investigation under Section 156(3). The appeals by violators were partly allowed (quashing MMDR Act proceedings only), while the State's appeal was dismissed.
