The Supreme Court held that 471 posts of Legal Advisors, Law Officers and Law Instructors created by the State of Maharashtra in 2006 were contractual, not permanent. The Government Resolutions explicitly prescribed that appointments would be on contractual basis for 11 months with provision for two extensions, after which candidates must undergo fresh selection. Respondents who accepted these contractual terms in writing—which clearly stated they would not be entitled to permanent service benefits—were estopped from later challenging the arrangement.
