This appeal challenged the High Court's acquittal of two accused persons charged with murder and destruction of evidence (dismemberment of the victim's body). The prosecution's case rested primarily on the testimony of a single eyewitness (PW7) who claimed to have witnessed the crime at night without electricity. The Supreme Court upheld the High Court's acquittal, finding PW7's evidence unsafe for conviction because: she failed to identify the accused at the time; neither she nor her husband (also allegedly present) raised any alarm in a densely populated area but went to sleep instead; and she delayed reporting the incident by one and a half months. The Court reaffirmed that while sole eyewitness evidence may support conviction if reliable and corroborated, here the circumstances rendered it insufficiently credible."
