Job contract employees in Odisha challenged denial of full pension credits for their pre-regularisation service. The Supreme Court allowed the State's appeals, holding that the Odisha Pension Rules 1992 create a clear statutory distinction between work-charged employees (entitled to full service credit upon regularisation) and job contract employees (entitled only to partial service credit sufficient to qualify for pension). The Tribunal had misinterpreted prior judgments. The Court declined to examine whether this distinction violates Article 14, as neither party challenged its constitutionality. However, the Court criticised the State's inexcusable delays and imposed costs.
