State of Orissa vs Duleswar Barik

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

A man was convicted of murder and sentenced to death, but the High Court later acquitted him on grounds of insanity, directing that he be detained for medical treatment until deemed safe to release. When his father sought his custody, the High Court allowed this and awarded Rs. 20 lakh compensation for detention despite acquittal. The Supreme Court held that no compensation was due because the detention followed the High Court's own medical treatment order, not any fault of the State. The Court set aside the compensation direction.
