The State argued that 2.5 hectares of the area was charagah (grazing) land and that the mining application had lapsed under the sunset clause in the MMDR Amendment Act, 2015. The Supreme Court dismissed the appeal, holding that the mining plan had already excluded the charagah land and the State had compensated by allocating alternative land. Following the precedent in Wonder Cement Limited v. State of Rajasthan, the Court ruled that procedural delays must be ignored when calculating the lapse period, and both objections failed.
