The State of Rajasthan challenged the High Court's order directing regularization of Shiv Charan Meena, a driver hired on contract during another employee's deputation. When the regular employee returned from deputation, Meena's services were terminated. The Supreme Court held that repatriation of a regular employee to their parent department lawfully ends the need for the contractual position. This was not wrongful substitution by another contractual employee, but restoration of the original incumbent. The Court allowed the appeal, set aside the High Court's order, and dismissed Meena's claim for regularization, though awarded additional costs to him."
