State of Rajasthan vs Kanhaiya Lal

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The State of Rajasthan appealed against the High Court's order converting the accused's murder conviction (Section 302, IPC) to causing death by negligence (Section 304, IPC). The Supreme Court found the High Court's conversion manifestly perverse and contrary to evidence, and therefore unjustifiable. Upholding the trial court's judgment, the Court restored the murder conviction and life imprisonment sentence. The accused was ordered to surrender immediately if already released under the High Court's order, thereby ensuring justice and preventing a complete failure of the judicial process.
