The State of Rajasthan appealed against a High Court order granting appointment to a candidate (Kiran Meena) against a vacancy that arose when a senior-ranked candidate did not join. Ten posts were reserved for Scheduled Tribe women, three of whom were sub-reserved under a tribal sub-plan scheme. Seven senior candidates were offered posts; three did not join. The High Court allowed the respondent's claim to the vacancy. The Supreme Court held that under Rule 20(2) of the recruitment rules, vacancies from non-joining must be treated as fresh vacancies for subsequent selection, not filled from the existing candidate list. The Court allowed the appeal and set aside the High Court's order.
