State of Rajasthan vs Sahi Ram

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The State of Rajasthan challenged the High Court's acquittal of Sahi Ram, who had been convicted at trial for possessing and transporting 223 kilograms of illegal Dodachura without a valid license. The Supreme Court held the High Court's reasoning unsustainable, finding that the prosecution had established through cogent evidence that the narcotic drug was seized from the respondent's actual possession and exceeded commercial quantity limits. The Court restored the trial court's conviction and imposed the mandatory minimum sentence of 10 years rigorous imprisonment under the Narcotic Drugs and Psychotropic Substances Act, 1985.
