State of Tamil Nadu and Ors vs K. Balu and Ors

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

The Supreme Court clarified its earlier order banning liquor license sales along national and state highways. The State of Tamil Nadu sought clarification on whether this ban extended to licensed establishments within municipal areas. The Court held that the prohibition targets highways providing inter-city connectivity, not licensed premises within municipal limits. Accordingly, the ban does not prevent states from issuing or renewing liquor licenses within municipalities, even where highways pass through them. This clarification applies uniformly to all municipal areas nationwide.
