A clerk appointed in 1983 was dismissed without notice after just five months. The Labour Court found this termination illegal and an unfair labour practice, ordering reinstatement. The High Court upheld the decision. The Supreme Court dismissed the employer's appeal, confirming that the 240+ days of continuous service (counting artificial breaks) protected the employee from arbitrary dismissal. Although the Labour Court had denied back wages on a technical ground, the Court ordered payment of full front wages from the Award's effective date until reinstatement, along with backdated pay and consequential benefits within eight weeks.
