In Brief

The Supreme Court examined consolidated Special Leave Petitions challenging a prior judgment (Preetam Singh's case) that had restricted the Uttar Pradesh Vikas Parishad's authority over employee conditions of service. The two-judge Bench concluded that Preetam Singh's judgment erred in overlooking statutory provisions and qualifying language in the Avas Evam Vikas Parishad Act, 1965. The Court held that State Legislatures possess jurisdiction to regulate recruitment and employment conditions through executive orders. Finding the matter required authoritative clarification, the Bench ordered the case papers placed before the Chief Justice for constitution of a larger Bench.
