In Brief
A livestock official in Uttar Pradesh was terminated from temporary employment in April 1984 shortly after a murder charge was filed against him. After being acquitted in 1985, he sought fresh appointment in 1989, explicitly requesting a clean slate and stating he would not claim any benefits from his prior service. The High Court later allowed his writ petition seeking continuity of service from 1984. The Supreme Court reversed this, holding that the respondent was bound by his clear undertaking to forego prior service benefits and was estopped from challenging the 1984 termination. Once an employee accepts termination and seeks fresh appointment on such terms, courts cannot later entertain challenges to the original termination.
