State of U.P vs Ram Kumar & Ors

Bench: 2 — Ashok Bhushan

In Brief

The State of U.P. appealed against the High Court's acquittal of five accused persons charged with murder. The High Court had rejected the trial court's conviction and death sentences, primarily on grounds that there was no light to identify the accused and the lantern was not burning at the time of the incident. The Supreme Court found these grounds untenable, holding that the injured eyewitnesses' testimony was highly reliable and trustworthy. The Court confirmed that the lantern was indeed burning, the accused were well-known family members who could be identified, and the FIR was properly lodged. The Court set aside the acquittal, but converted the death sentences to life imprisonment given the 10-year delay since the original judgment.
