Years later, individual family members successfully persuaded a lower court to issue a fresh notice, claiming they needed separate notification. The High Court allowed their writ petition. The Supreme Court held that reopening settled matters violates res judicata and constitutes abuse of process. The Court set aside the High Court's order and directed the District Magistrate to take possession of the surplus land (33 Biswa 8 Bigha and 14.8 Biswansi) for redistribution to landless persons.
