STATE OF UTTARAKHAND vs PREM RAM

Bench: 2 — Dhananjaya Y Chandrachud, Hemant Gupta

In Brief

A police constable employed since 1987 was dismissed for misconduct involving drunkenness and misbehavior with the public in 2006, with intoxication proved by medical examination. After dismissal in 2007, the High Court's Single Judge upheld it in 2014, but a Division Bench converted the dismissal to compulsory retirement, citing 25 years of satisfactory service. The Supreme Court reversed the Division Bench, holding that given the serious nature of the misconduct and the officer's police role, the High Court had no justification to interfere with the properly concluded dismissal order. The appeal was allowed and the dismissal order was restored.">
