State of West Bengal & Anr vs Basudev Das & Ors

Bench: 2 — Kurian

In Brief

This case concerns an interim order by the High Court of West Bengal in a dispute over the selection and appointment of Sub-Inspectors through a Limited Departmental Competitive Examination. Some candidates had challenged the appointment process before a Tribunal, claiming discrimination regarding height requirements. The Tribunal set aside the entire selection process. When the State appealed the High Court's refusal to stay that order, the Supreme Court intervened under Article 136 and stayed both the Tribunal's order and the High Court's interim order, allowing the recruitment process to continue. The Court requested the High Court to dispose of the underlying writ petition within six months, with the Supreme Court's interim stay remaining in effect until then.
