The Supreme Court examined whether the death of the main accused (a public servant charged under the Prevention of Corruption Act) abates the trial against him and other accused (non-public-servants charged as abettors). The High Court had dismissed a revision petition solely on the ground that the main accused's death resulted in trial abatement. The Court held that death of the main accused does not automatically abate the trial and remanded the matter to the High Court to decide the discharge order on merits, while also allowing reconsideration of the court's jurisdiction to try the non-public-servants' charges.
