The Supreme Court addressed whether the CBI could conduct further investigation and file a chargesheet after previously submitting and obtaining acceptance of a closure report. The Court held that Section 173(8) of the CrPC permits further investigation even after acceptance of a closure report, provided fresh evidence emerges. Further investigation is merely a continuation of earlier investigation, not a re-investigation. The principle of double jeopardy does not apply. The Court also criticized the High Court's second bench for disregarding an earlier bench judgment without proper judicial procedure. The special court was directed to proceed with trial, allowing the CBI's appeals.
