Subhash Chander Bansal vs Gian Chand and Ors

Bench: 3 — Abhay Manohar Sapre

In Brief

Five accused persons were charged with causing grievous injuries to two persons using a hockey stick. The trial court acquitted all of them. The State appealed and the High Court partially allowed it, convicting four of the accused under Section 325 read with Section 34 IPC (grievous hurt by common intention), while acquitting one person. The High Court imposed a sentence for time already served in custody plus a fine of Rs. 50,000/- shared equally. The complainant appealed, arguing the sentence was inadequate. The Supreme Court dismissed the appeal, upholding the High Court's conviction and sentence, finding that the evidence supported grievous hurt rather than attempted murder, and that the sentence was appropriate given 30 years had elapsed since the 1988 incident.
