A property in Kaithal was originally leased to Burmah Shell in 1958 for 20 years. After nationalization under the Burmah Shell (Acquisition of Undertakings) Act, 1976, Bharat Petroleum Corporation became the lessee. The lease was renewed for another 20 years until 1998. When the lease expired, the owners filed a civil suit for possession. The Court held that once a tenant becomes a statutory tenant under the Haryana Rent Control Act (which applied to the property), only that Act—not the Civil Court—can order eviction. The appeal was dismissed, confirming that jurisdiction of civil courts is barred in such matters.
